08/02The Pond at the Bonbrook on Concord Entrance

From time to time, your Board receives calls from concerned residents that have sighted children playing at the pond and in some instances have actually used it for wading or swimming.  Also noted is the winter ice that seems to draw children to the pond.  We caution everyone to warn your children about using the pond for any activity regardless of season.  This pond has an aerator/fountain which is electrical and wires are located on the pond floor that runs to the pump/controller.   While the equipment is inspected on a monthly basis, an electrical problem could develop and could cause serious injury to anyone that enters the pond.

Also please advise your children not to throw articles in the water, as they could cause failure of the aerator/fountain.  This is especially true during the winter when the pond is covered in ice.  Throwing stones and other articles on the ice will eventually create problems during the thaw.

We appreciate your help in keeping that area attractive.  The pond feature is what’s immediately noticed by prospective home buyers and it leaves a good impression and certainly adds value to our neighborhood.

08/02Trees on Residents’ Property

Your Board has received comments relative to dead trees on resident’s lots.  We encourage you to take the appropriate action to avoid damage to homes should these trees fall either by wind storms or because it is rotted.  You could also be responsible for damage to a neighbor’s   property.

Trees are tricky.  The best thing to know is that every homeowner is responsible for what’s in his or her own yard.

If a neighbor’s tree lands on your property, it’s then considered in your yard.  Your homeowners insurance will help cover the removal of the tree and any damage it caused, after your deductible.  The same is true in reverse:  if your tree falls in your neighbor’s yard or on their roof, they should file the claim with their insurance.

Neighbors are usually able to work out what needs to be done without too much disagreement.  However, if the tree has been identified as a problem tree – one that’s rotting or that’s split before – the case might get a little heated and one person can be considered liable for the damage.   When that happens, one homeowner’s insurance company may try to settle the claim with the other’s homeowner’s insurance in a process called subrogation.

To ensure this doesn’t occur, tend to the health of all the trees on your property.  Prune them regularly and if the tree’s health is questionable, call a specialist before any damage occurs.
